The
Judicial System Monitoring Programme (JSMP) was set up in early 2001
in Dili, East Timor. Through court monitoring, the provision of legal
analysis and thematic reports on the development of the judicial system,
and outreach activities, JSMP aims to contribute to the ongoing evaluation
and building of the justice system in East Timor. For more information,

1. Trial
Observation
JSMP has:
- Sent legal observers to
more than 150 trial sessions and preliminary hearings before
the Special Panels for Serious Crimes in the Dili District
Court, covering more than 90% of all the Serious Crimes hearings
since trials commenced in January 2001
- Interviewed judges, court
registrars, public defenders, investigators, public prosecutors
and other East Timor justice system participants
- Monitored East Timor trials
in Indonesia's Ad Hoc Human Rights Court .
2. Judicial System Analysis
JSMP has:
- Published reports and commentaries
on topics including
Human rights in Court Administration
with a focus on the Special Panels for Serious Crimes, and the
Right to Appeal in East
Timor
The Los Palos
case, the first time a court has applied the principles of
the law to be used by the International Criminal Court; and
- East Timorese draft legislation such as the Judicial Magistrates
law and Amnesty for Crimes law
- Contributed to the NGO Forum
briefing paper to the Canberra Donor's Conference on Justice and
Human Rights issues
- Contributed to the United
Nations Mission of Support for East Timor's August 2002 strategy
paper on judicial system reform

| Women's
Justice Unit |
In
late 2003, JSMP’s women researchers acquired access to closed
sexual assault proceedings in Dili District Court and conducted
widespread interviews of police, prosecutors, victims, judges and
NGOs about issues affecting women in the formal justice sector.
The results of the monitoring were memorialized in the report “Women
in the Formal Justice Sector”. The report found that more
attention should be given to the plight of female victims of domestic
violence, sexual assault and rape, in Timor. In addition, the report
made a number of recommendations.
JSMP’s Women’s Justice
Unit was formed in April 2004 as the logical next step after the
launch of report. The Women’s Justice Unit attempts to implement
some of the recommendations from the report “Women in the
Formal Justice Sector”. The Women’s Justice Unit has
also conducted the following work:
- Sent legal observers to monitor
women related cases in Dili District Court,
- Published reports and commentaries
on topics including “An Analysis of a Sexual Assault Decision
from Dili District Court”, and “Access to Justice
for Women Victims” and .....click

- Produced a range of public
education materials on sexual assault and domestic violence including
brochures, posters, and a radio program and distributed these
materials to all the districts in East Timor, and
- Conducted training of prosecutors
in prosecuting domestic violence.
- Conducted training on the formal justice system and domestic
violence and sexual assault to police, local government leaders
and womens groups in the districts level.

| Outreach
Unit |
JSMP has:
- Maintained JSMP website (including
daily update and upload), that has had over 10.000 viewers since
its launch in mid 2002. The site includes case summaries from
the Serious Crimes panels and Indonesia's Ad Hoc Human Rights
Court , court schedules, copies of indictments and judgments.
- Regularly distributed to
over 408 subscribers frequent East Timor judicial system updates
from the JSMP e-mail list, including JSMP
reports on recent cases.
- Briefed and been quoted by
a number of international media outlets including the BBC, CNN,
Time Magazine Asia, the Boston Globe, Atlanta Constitution, the
Sydney Morning Herald, The Guardian, Agence France Presse and
Associated Press.
- Participated in human rights
training for Timorese judges, lawyers and police.
- Facilitated observers of
the East Timor trials in Indonesia providing information sessions
on the outcomes of the trials to relevant victim's groups in and
outside district Dili.
