Under strong international pressure, the Government of Indonesia
had eventually agreed to establish a legal framework for the prosecution
and trial of the gross human rights violations that had been committed
in East Timor in 1999. 18 suspects were put on trial before Ad-Hoc
Human Rights Courts in Jakarta. Most of the defendants have been
acquitted. Those few who have been convicted have been handed down
minimum or even sub-minimum sentences.
Watch Indonesia! felt the need to initiate a trial observation
and, in cooperation with the German Commission Justitia et Pax,
Misereor, missio Aachen and the Human Rights Desk of Diakonia, the
Social Services Agency of the Protestant Church in Germany, to commission
a legal opinion. With Attorney at Law Bernd Häusler, Vice President
of the Berlin Bar Association and its Human Rights
Commissioner, an experienced trial lawyer could be engaged for this
task. In his legal opinion Häusler examines the proceedings
and the legal context in which they take place, puts the trials
into international perspective and, against this background, presents
an evaluation. The guiding question is: "Are the international
standards met by the criminal proceedings regarding the events
in East Timor in 1999, which were instituted before the Human Rights
Court in Jakarta in March 2002 or are the same only 'mock trials',
in order to avoid an ad-hoc tribunal as threatened by the international
community?"
