Medan, N Sumatra, March 11 (ANTARA) - East Timor President Xanana
Gusmao has said that human rights violators in the wake of the 1999
vote for independence in East Timor will not receive automatic amnesty.
"If you look at the terms of reference of the Commission of
Truth and Friendship, you will find that there will be amnesty but
it would not be granted automatically," the East Timor President
said on the sidelines of the Lake Toba Summit here on Thursday.
He said that based on the East Timor Constitution, any amnesty
shall be proposed to the Parliment. The Parliament has the authority
to approve or disapprove it.
Xanana said that amnesty could be offered to violators who showed
cooperative attitude and were ready to reveal the truth; and for
this, the Commission of Truth and Friendship (CTF) would recommand
an amnesty.
Basically, the CTF would not grant autmatic amnesty, but invite
suspected violators to say the truth, he said. The commission is
set up to uncover the truth.
Indonesian President Susilo Bambang Yudhoyono, Xanana and his Prime
Minister Mari Alkatiri signed an agreement at the presidential place
in Jakarta on Wednesday to set up a commission to deal with human
rights atrocities in 1999.
The two presidents reiterated their commitment to settling their
common "burden of the past" through a bilateral means,
not through the United Nations' Commission of Experts.
The CTF came amid the setting up of the UN Commission of Experts
by the UN Secretary General Kofi Annan. The UN Commission aims to
review the perfomance of the East Timor Rights Tribunal set up by
Indonesia.
Xanana indicated his country would have no problems to cooperate
with the UN Commission and be ready to receive if it visited East
Timor.
"We have been officially informed that the Indonesian government
rejects (the UN Commision) and we appreciate its decision just like
the Indonesian government appreciates our decision," Xanana
said.
Indonesia has make its stand clear. Indonesia would not cooperate
with the UN Commission because it has no explcit mandate from the
UN Security Council.
